Terms & Conditions of Use and Service

1) Who we are

HotelPetLovers.net (the “Platform”) is owned and operated by AG Consulting srl (“we”, “us”, “our”).

These Terms govern all access to and use of the Platform.

2) What we do (marketplace; no agency)

We provide an online intermediation and hosting service that enables accommodation providers (“Advertisers”) to publish listings and travellers (“Visitors”) to discover and contact them. We are not a party to any booking or stay and we do not act as agent of Advertisers or Visitors. Any contract, availability, price, tax, pet rules or services are agreed directly between Advertiser and Visitor.

3) Acceptance of these Terms

By using the Platform you accept these Terms. If you purchase a paid plan, you also accept the plan conditions shown on our Pricing Plan page (incorporated by reference).

4) Users and scope

5) Accounts

Each legal entity may hold one account and must ensure that all information is accurate and current. Keep credentials confidential. Advertisers warrant they are authorised to represent the property and comply with all licences, permits and tax obligations.

6) Content is provided by Advertisers (hosting; no editorial control)

Listings (texts, photos, prices, pet policies, availability, promotions) are provided by Advertisers. While we may format or highlight content, we do not pre-approve, verify or guarantee accuracy, availability, prices, amenities or pet rules. As a hosting provider, we are not responsible for user-generated content unless we obtain actual knowledge of unlawful content and fail to act expeditiously. See Clause 14 (Notice and action).

7) Ranking & visibility (transparency)

Search and placement may depend on these main parameters (which we may refine over time):

  1. Query relevance & location match (high)
  2. Listing completeness & freshness (high)
  3. Quality signals (e.g., response speed, traveller feedback) (medium)
  4. Compliance & low complaint rate (medium)
  5. Plan tier and paid promotional options (may grant badges/boosts/featured slots) (medium)
  6. Editorial collections/tests (low, time-limited)

We will give Business Users at least 15 days’ prior notice for material changes to these parameters, unless earlier changes are required for legal or safety reasons.

8) Plans, fees and billing

Advertisers can publish under free or paid plans shown on the Pricing Plan page. Prices are shown net of VAT; Italian VAT rules apply. Subscriptions renew automatically for the same term unless cancelled in the dashboard before renewal. Invoices are issued by AG Consulting srl.

Refunds. Visibility subscriptions are B2B services and are generally non-refundable once activated, save where required by mandatory law or in case of our material breach. Consumer withdrawal rights apply only where the customer qualifies as a consumer.

9) Acceptable use and Advertiser warranties

Users must not upload or transmit content that is illegal, misleading, defamatory, discriminatory, pornographic, incites hatred/violence, violates privacy or intellectual property, or breaches animal-welfare rules.

10) Intellectual property and licence

Advertisers retain rights in their content and grant us a non-exclusive, worldwide, royalty-free licence to host, cache, index, display and distribute such content on the Platform and our official channels to operate and promote the listing. All software, databases, design, and the Hotel Pet Lovers brand are our IP.

11) Reviews and traveller content

Reviews and photos by Visitors reflect personal opinions. We may remove or flag content that appears fake, unlawful or off-topic and may request evidence of a stay. We are not responsible for third-party reviews.

12) Availability of the Platform

We aim for high availability but do not guarantee uninterrupted access. Maintenance, updates, third-party outages or force majeure may temporarily affect the service.

13) Suspension, de-listing, termination

We may restrict visibility, suspend or terminate an account or listing if we reasonably believe content or conduct is unlawful, harmful, deceptive, or breaches these Terms. Business Users will receive a statement of reasons and a channel to contest decisions, unless doing so would risk legal or safety harm. Serious or repeated breaches may lead to permanent removal.

14) Notice and action (reporting unlawful content)

To report content you believe is illegal or rights-infringing, email info@hotelpetlovers.net or send a formal notice to agconsulting_srl@pec.it, providing:

15) Data protection & cookies

We act as data controller for personal data processed via the Platform. Details on purposes, legal bases, retention and user rights are set out in our Privacy Policy and Cookie Policy. For privacy queries, contact info@hotelpetlovers.net.

16) Disclaimers

Except where prohibited by law, the Platform and all information are provided “as is”. Without limiting the above:

Nothing in these Terms excludes liability for wilful misconduct or gross negligence where such exclusion would be unlawful.

17) Limitation of liability

To the maximum extent permitted by law: (a) we are not liable for indirect or consequential loss, loss of profits, or loss of data; (b) our aggregate liability to a Business User in any 12-month period is limited to the fees paid to us for the affected service; and (c) our aggregate liability to a Visitor is limited to €100. Statutory consumer rights (where applicable) remain unaffected.

18) Indemnity (Business Users)

Advertisers agree to indemnify and hold harmless AG Consulting srl from any claim, fine, damage, cost or expense arising from their content, operations, unlawful discrimination, misuse of personal data, IP infringement, or breach of these Terms.

19) Changes to these Terms

We may modify these Terms to reflect legal, technical or operational changes. For material changes affecting Business Users, we will provide at least 15 days’ prior notice on a durable medium, unless a shorter period is necessary for legal or safety reasons. Continued use after the effective date constitutes acceptance.

20) Complaints and mediation (Business Users)

Business Users may file complaints to info@hotelpetlovers.net regarding: (i) alleged non-compliance with these Terms; (ii) technical issues; or (iii) suspension/termination. We will review and respond within a reasonable time. If unresolved, we are willing to engage in mediation with an independent mediator in Italy, without prejudice to judicial remedies.

21) Governing law and jurisdiction

These Terms are governed by Italian law. Any dispute with Business Users is subject to the exclusive jurisdiction of the Courts of Teramo (TE), Italy. If you are a consumer, the mandatory forum of your habitual residence applies where required by law.

22) Final provisions

If any provision is invalid, the remainder remains effective. Failure to enforce a provision is not a waiver. These Terms constitute the entire agreement between you and us regarding use of the Platform. Where we publish these Terms in multiple languages, the Italian version (if and when published) will prevail in case of conflict.
